Maternity Protection at Work
Maternity cases are high-risk terminations. One wrong letter during pregnancy or maternity leave can turn a staffing decision into a statutory offence exposure.
This is not a routine HR exit
Under the Employment Act framework, eligible female employees are protected around confinement through maternity leave and maternity allowance rules. More critically, termination during maternity leave is tightly restricted, and action against a pregnant employee can place the burden of proof on the employer in key situations. Treat every maternity-linked case as a compliance file, not a normal resignation or performance exit.
1. Leave and allowance are statutory, not optional perks
- Eligible employees are entitled to maternity leave for each confinement
- Maternity allowance is generally linked to ordinary rate of pay for the eligible period
- Eligibility and notification steps matter — process failures can affect outcomes
- Do not “informally adjust” leave in a way that undercuts statutory entitlement
2. Termination during maternity leave is high exposure
- Terminating a female employee during maternity leave is an offence except in limited situations
- Business closure is an example of a narrowly framed exception area — not a casual justification
- Managers must not use restructuring language to mask a maternity-linked exit
- Any proposed action needs legal review before letters are issued
3. Pregnancy-related terminations need extreme care
- There are restrictions on terminating pregnant employees except on specified grounds
- In important situations, the employer may carry the burden of proving the reason is lawful
- “Performance” narratives built after pregnancy disclosure are especially risky
- Keep contemporaneous records if performance issues existed before disclosure
4. Leave interaction mistakes create disputes
- If sick leave or maternity leave falls during annual leave, apply the correct leave type
- Do not force annual leave to absorb maternity entitlement
- Keep separate tracking for annual leave, sick leave, and maternity leave
- Payroll and HR systems must reflect the same leave classification
5. What strong HR teams do early
- Train managers not to improvise conversations about pregnancy and job security
- Use a standard maternity notification and leave workflow
- Confirm allowance calculation method with payroll before confinement starts
- Escalate any termination proposal involving pregnancy or maternity leave immediately
- Protect medical and pregnancy-related personal data under PDPA principles
Quick compliance checks
- Is the employee eligible for maternity leave/allowance under the Act’s framework?
- Has notification and documentation been handled correctly?
- Is any proposed exit happening during maternity leave or pregnancy?
- Are performance concerns documented from before disclosure?
- Has counsel reviewed the file before any letter goes out?
