Inside the Inspector's Toolkit: OSH Enforcement

Under Part XI, an officer has the power to enter, inspect, and examine any workplace at any reasonable time. They can seize evidence, take photographs, and require the production of any documents or computerized data. If an inspector identifies an immediate danger to life or property, they are empowered to serve a "Prohibition Notice," effectively shutting down the operations until the risk is eliminated.

Crucially, Section 46 places a responsibility on the employer to assist these officers. Obstructing or hindering an inspector is a criminal offence that can result in fines of up to RM10,000 or imprisonment. This robust enforcement mechanism ensures that safety regulations are not merely suggestions, but enforceable requirements.
