The Occupational Safety and Health Act 1994 (Act 514) establishes a "duty
of care" for everyone in the workplace. Recent comprehensive amendments
(Act A1648), effective June 1, 2024, have significantly strengthened
compliance requirements and expanded protections for all Malaysian workers.
The 2024 update introduced Section 26A, which empowers employees with the
right to remove themselves from a work situation if they have reasonable
justification to believe there is an "imminent danger." Furthermore,
Section 18B now mandates that all employers and principals must conduct
and implement formal risk assessments to proactively manage workplace
hazards before accidents occur.
Penalties for non-compliance have seen a massive increase to deter
negligence; the maximum fine for a breach of general duties has risen
from RM50,000 to RM500,000. This shift moves the industry away from a
prescriptive "check-list" mentality toward a philosophy of
self-regulation, where the responsibility for a safe environment is
embedded into the core operations of every business.
