The Employment Act 1955 includes rigorous provisions under Part XVA to
address sexual harassment in the workplace. These laws apply to all
employees regardless of their wage levels, ensuring a safe working
environment for everyone.
Under Section 81B, employers are legally required to inquire into any
complaint of sexual harassment. If an employer refuses to conduct an
inquiry, they must provide written reasons to the complainant within
30 days. Failure to comply with these procedural requirements is an
offence that carries a fine of up to RM50,000.
Furthermore, Section 81H mandates that employers must at all times
exhibit a notice at the place of employment to raise awareness
regarding sexual harassment. If harassment is proven during an
internal inquiry, the employer has the right to take disciplinary
action, which may include instant dismissal without notice.
